Terms of Service

1.1. Acceptance of Terms

By accessing or using Gigcoms (gigcoms.com), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the service.

2.2. Description of Service

Gigcoms is a platform for managing live music bookings and communication. The service includes:

  • Creating, managing, and tracking bookings between artists and bookers
  • Generating and signing digital contracts
  • Messaging between parties involved in bookings
  • An AI-powered assistant to help manage bookings, contracts, and communication
  • Integration with external messaging channels (WhatsApp, email) through connected accounts
  • Technical rider management and shareable rider pages
  • Advance sheets for day-of-gig coordination
  • Public booking pages with availability calendars

3.3. User Accounts

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the security of your account credentials
  • You may not create multiple accounts for the same person
  • You must be at least 16 years old to use the service

4.4. Acceptable Use

You agree not to:

  • Use the service only for lawful purposes related to music bookings and event management
  • Send spam, unsolicited messages, or abuse the messaging system
  • Scrape, crawl, or automatically extract data from the service
  • Impersonate another person or entity
  • Upload malicious code or attempt to compromise the service

5.5. AI Assistant

The AI assistant is a tool to help you manage bookings — it does not replace your judgment. Always review AI-generated content before sending.
  • Gigcoms provides an AI assistant to help manage your bookings and communication
  • You are responsible for reviewing and approving actions taken by the AI on your behalf
  • AI-generated content (messages, contracts, suggestions) may contain errors. Always verify important details before confirming
  • When the AI responds on your behalf through connected channels, you remain responsible for the content
  • AI auto-negotiation operates within the rules you configure. You can require manual approval for all AI responses.

6.6. Your Content

You retain ownership of all content you create on Gigcoms, including profiles, bookings, contracts, and messages.

You grant Gigcoms a limited license to store, process, and display your content as necessary to provide the service.

7.Public Artist Pages

When you enable your public profile, the following information is visible to anyone:

  • Your artist name, bio, avatar, location, and social media links
  • Your availability calendar (booked/available dates, not booking details)
  • Public testimonials from past clients
  • Your gig history (venue names, cities, dates)
  • Your technical rider (if published)

You can disable your public profile at any time in Settings. This immediately removes your page from public access.

8.7. Payments & Fees

  • Payments for bookings are arranged directly between artists and bookers. Gigcoms facilitates tracking but does not process payments
  • Gigcoms is not liable for disputes, non-payment, or cancellations between parties
  • Gigcoms may introduce subscription fees for premium features in the future with advance notice
  • Payments processed through Stripe are subject to Stripe's terms of service and processing fees.
  • Deposits collected via GigComs are held by the artist's connected Stripe account, not by GigComs.

9.Intellectual Property

  • The GigComs name, logo, and branding are the property of GigComs ApS.
  • You may not use our branding without written permission, except for the "Powered by GigComs" badge on your public page and embedded widgets.
  • Contract templates provided by GigComs are for your use on the platform. They do not constitute legal advice.

10.Beta & Preview Features

Some features may be labeled "Beta" or "Preview". These features:

  • May change or be removed without notice
  • May have reduced reliability or performance
  • Are provided "as is" without warranty
  • Your feedback on beta features helps us improve the product

11.8. Termination

  • You may delete your account at any time through settings or by contacting us
  • We may suspend or terminate accounts that violate these terms
  • Upon account deletion, your personal data will be removed in accordance with our Privacy Policy
  • Active bookings and contracts remain valid between the parties regardless of account status on GigComs.

12.9. Limitation of Liability

Gigcoms is provided "as is" without warranties of any kind, express or implied. We do not guarantee uninterrupted or error-free service.

To the maximum extent permitted by law, Gigcoms shall not be liable for any indirect, incidental, or consequential damages arising from your use of the service.

GigComs is not a party to bookings between artists and bookers. We are a platform that facilitates communication and management — we do not guarantee performance, payment, or attendance at events.

13.Indemnification

You agree to indemnify and hold GigComs harmless from any claims, damages, or expenses arising from:

  • Your use of the service
  • Content you create or share through the platform
  • Disputes between you and other users or clients
  • Your violation of these terms

14.Dispute Resolution

In the event of a dispute:

  • Step 1: Contact us at legal@gigcoms.com. We will attempt to resolve the matter informally within 30 days.
  • Step 2: If unresolved, either party may initiate mediation through the Danish Mediation Institute.
  • Step 3: These terms are governed by the laws of Denmark. Any disputes shall be resolved in the courts of Copenhagen, Denmark.

15.General Provisions

  • Severability: If any provision is found unenforceable, the remaining provisions remain in full effect.
  • Entire agreement: These terms, together with the Privacy Policy, constitute the entire agreement between you and GigComs.
  • Force majeure: GigComs is not liable for failures caused by circumstances beyond our control (natural disasters, government actions, internet outages).
  • Changes: We may update these terms from time to time. We will notify users of significant changes via email or in-app notification. Continued use of the service after changes constitutes acceptance of the updated terms.
  • Assignment: You may not assign your rights under these terms. GigComs may assign its rights in connection with a merger or acquisition.
